Kazakhstan’s national airline, Air Astana, filed a lawsuit with the New York Supreme Court in Manhattan against Embraer, VLAST.KZ reported, citing Reuters reports.
In its lawsuit, the airline accuses the Brazilian aircraft manufacturer of breach of contract and warranty and is demanding $ 11.9 million.
In its lawsuit, Air Astana accused Embraer of “conduct that was (at best) careless and showed a reckless indifference to human life.”
Embraer said in a statement that the company has denied breach of any obligations to Air Astana and will “vigorously defend” against any claims.
“Air Astana seeks compensation for its unilateral decision to suspend flights and was the only airline to suspend the use of E2 aircraft, doing so only temporarily and then resuming all flights,” the statement said.
Air Astana claimed in the lawsuit that five Embraer E190-300 regional jets leased from Embraer were experiencing serious security problems.
These include wing de-icing system failure requiring an emergency landing, hydraulic system “cascade” failure during landing, uncontrolled altitude changes and mechanical failures leading to a missed approach.
